Amendment VIII
Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.
Summary of Amendment VIII:
If you have committed the crime the punishment must fit the crime. If you had robbed a store or a person your punishment must match the crime so you can’t be sentenced to death because you robbed a person or a store. And Vice versa if you kill a person and your punishment is a 1 year in prison or bail that cost $100 doesn’t match the crime. During a trail if you committed a crime the jury must give you a reasonable punishment that matches the crime it can’t unfair and unreasonable punishment.

Big Ideas
1) Torture
Amendment 8 also relates to torture and [punishment given to a person when they commit a crime but it usual and doesn’t match the crime.
Amendment 8 relates to punishment that doesn’t match a crime committed however there are different types of usual punishments
Punishment given is related to or treated like a punishment given to an animal. Based on the country you’re the torture is like you’re an animal and you are in trouble.
If a judge gave you an usual punishment then its against the laws and they will be in court however before they were forced to accept their punishment and deal with it.
It shows how torture relates to the 8th amendment because of the usual punishment people receives or gives.
2) Discrimination (Unfair Punishments based on race)
Due to the 8th Amendment people have been given punishments just because of their races.
This website explains that unfair/ cruel punishments was also given to people because of their race. For example if you was black your punishments will be cruel which is unfair and cruel towards those people.
This website shows that judges also gave people unusual punishments based of their religion. The religious discrimination violates the 8th amendment.
This shows that in other countries that discrimination which is related to the 8th amendment is high and greatly affects people.
The 8th Amendment relates to unfair punishments relating to your race or your religion. Cruel punishments are given to people based on discrimination.
3) Waterboarding:
Waterboarding is a usual and cruel punishment and people where hung up and poured water on like they were drowning.
The 8 amendment is about how back in the old times they were usually punishments when you committed a crime like water boarding but soon it became an illegal to do that to a person who committed a crime.
Waterboarding was used by the CIA to victims by covering their faces and pouring water on them. There was 266 victims that their punishment was water boarding.
A person water boarded his own step daughter violating the 8th amendment of cruel or usual punishment causing him to end up behind the bars.
In the past, throughout history people had used waterboarding in wars and as punishments in court but now it is illegal. If someone water boarded you that will be violating the 8th Amendment.

1- the idea of waterboarding is different from other people because the CIA doesn’t think of waterboarding as a bad thing; but others might think of it as torture.
I agree because the CIA used waterbaording to gain information from the enemies so they believe that waterboarding was a good idea but other believe that waterboarding is torture and shouldn’t happen.
2- the CIA is defending the idea of waterboarding because the only reason that they use waterboarding is because the guy that they were waterboarding was someone that used for interrogation of terror suspects.
Your right. The CIA is using waterboarding to get enemies to talk so they didn’t want waterboarding to become illegal.
3- in a way waterboarding is a good thing because it’s used to torture terror suspects but at the same time its torture and people shouldn’t use it or do it.
True but you can add because people were sadden by the use of waterboarding but it is a benefit because the police/government gained valuable information from enemies.
4- I would say that the CIA could win the argument of use of waterboarding. I say this because it’s not like the CIA is using waterboarding as a bad thing if it’s for terror suspects.
True but I disagree with that because even though the CIA used waterbaording to get suspects to talk but more people believe that waterbaordung is bad and shopuldnt be used no matter what.
5- the idea of waterboarding has changed over time because before waterboarding was only with a piece of cloth on your face but then it changed to police forces using it in the U.S. For example, the CIA.
True and that’s what I believe. Before waterboarding wasn’t used greatly but now the CIA uses it to get suspects to talk and t6he police forces used it a lot before the waterbaording became illegal.
