PGD40S - Photography Contracts

Introduction

PGD40S - APPLIED PHOTOGRAPHY

The Applied Photography course focuses on the business of photography. As the pinnacle course of the photography program, Applied Photography is designed to prepare students for a career in the photography industry either working with a commercial studio or starting their own photography business.

As part of doing any business, having a contract with clients is a good practice. Contracts clearly set out the expectations and limitations between the photographer, who is providing a service, and the client, who is paying for that service. A contract protects the interests of both parties involved with a legal transaction. A contract also defines the service which the photographer is providing and details the obligations of the client.

Task

Learning Outcomes

  • 12D.11.3.2 Develop a contractual agreement.

Students will research and develop their own contractual agreement.

Process

Consider the following situations.

  1. A client has booked you for a photography shoot but fails to show up at the agreed upon location and time.
  2. Your client insists that you hand over all your images and states that they are his property.
  3. When photographing a wedding, you miss a moment at the alter because the best man decided to wave his hand in front of your camera.

How would having a contractual agreement help a photographer with these situations?

Procedure

Students will develop their own contractual agreement which will be due at the end of the week.

  • Step 1: Research and review a variety of contractual agreements used by Canadian photographers. Use the internet to research.
  • Step 2: Create a list of key points which should be included in your agreement.
  • Step 3: Create your own contractual agreement, using Word or another word processing program, which will be printed and submitted to the teacher.
  • Step 4: Included with your submitted Contractual Agreement, students will include a 300 word reflection on the importance of having a contractual agreement when starting a photography business.

There are a series of internet links to sites which discuss what should be covered in an agreement and links to samples. You can use these links as resources.
